BUYERS – What to Know

  • The Yard Sale begins at 8am! Be respectful of the time to start selling.
  • Preferred method of payment is cash. Select Vendors may offer Paypal and/or Venmo options” .
  • Free Parking is available directly across First Street from the selling grounds. Do Not Park in spaces marked for ArtsQuest Members Only. Parking Tickets will be issued to violators. Click here for more parking details.
  • Wagons and small carts are permitted but please be courteous while navigating through the crowd.

VENDORS – What to know

  • The Hawk Morning Rave Spring Cleaning Yard Sale takes place Saturday, May 4, 2024, from 8 am to 12 noon in the parking lot of SteelStacks on 1st Street; just off of Founders’ Way in Bethlehem, next to the ArtsQuest Visitors Center.* Vendors get 2 parking spaces – one for their vehicle and the one in front of the vehicle to display their wares. The Yard Sale is limited to 200 vendors – you must register and get your ticket on Sweet Deals. Over 1000 people come to shop – so be prepared!• Vendors will be allowed to enter the selling grounds around 6:30 am when gates open. Gates may open a little sooner depending on traffic.• By purchasing your space at the Yard Sale, you agree to the terms and conditions in the waiver section which permits photos taken on site.

    • Vendors will be lined up and parked in amusement park style.  If you want to be next to another vendor/car, make sure you arrive with them as you pull into the parking lot.

    • All items must be unloaded into the designated selling space. Participants are required to bring their own tables, chairs, and bags if they desire as long as they stay within their own area. Participants will be able to set their own prices and keep 100% of their profits.

    • ArtsQuest doesn’t allow un-associated businesses to use their property to sell items, meaning if you are a representative or consultant of Pampered Chef, Silpada, Tupperware, etc, you may not sell those items at this event. Just personal yard sale stuff.

    • Items that contain profanity or obscenity will not be tolerated and will be removed. Items such as weapons including knives, guns, bows, or anything else that may be deemed harmful or inappropriate will not be tolerated and will be removed.

    • Participants are required to safeguard their own belongings. There must be someone attending a space at all times.

    • Participants are not permitted to sell anything that is not in their possession, stolen items, or that does not exist at the time.

    • Participants are NOT permitted to sell food or drink. The City of Bethlehem requires that all food distributors have a license or permit to sell food of any kind. Participants in such will risk fines and/or removal from the event

  •  Mack Truck Snack Bar will be open to sell hot and cold beverages and breakfast sandwiches.

  • Restrooms are in the Visitor’s Center and open approximately 6:30am

     

  • Selling will begin at 8 am!

    • You must provide your own change. It is suggested that you start your bank with at least: (1 ) roll of quarters, (20) $1 bills, (4) $5 bills, and (1) $10 bills.

    • A dumpster will be provided to discard any unsold items and garbage. Once the garbage is placed in the dumpster it may not be removed. When the dumpster is full, all remaining items and garbage must be taken with you!

    *You are responsible for the removal of all of your remaining yard sale items at the conclusion of the event. You may dispose of items in the provided dumpster(s) or take them with you, but you are not allowed to leave them behind in your selling space.

    • Selling will conclude at 12 noon! Please be courteous and patient when leaving. Remember that it takes a little while to get all 200 vendors out of the lot! Make sure you please clean up your mess.

    • Tents are not permitted on site due to liability issues.

    •By purchasing a space, you agree to the PROMOTION/EVENT PARTICIPATION RELEASE AND WAIVER AGREEMENT in consideration of the opportunity afforded to me to participate in The Hawk Morning Rave Yard Sale.

PROMOTIONAL EVENT/CONTEST PARTICIPANT

ASSUMPTION OF RISK, LIABILITY RELEASE, AND INDEMNIFICATION AGREEMENT

This ASSUMPTION OF RISK, LIABILITY RELEASE, AND INDEMNIFICATION AGREEMENT (“Agreement”) is executed on the date set forth under the signature below by the undersigned (hereinafter “Participant”), who has been selected to participate in the “Hawk Spring Cleaning Yard Sale” (the “Event”) being held on Saturday, May 4, 2024 at ArtsQuest Parking lot on First Street in Bethlehem, in favor of radio station WODE-99.9 The Hawk, Allentown Cluster – Cumulus Radio LLC, its parent and subsidiary companies, affiliates, members, directors, shareholders, officers, employees and agents, whose address is 2158 Avenue C, Suite 100, Bethlehem, PA 18017, and all sponsors of the Event (hereinafter referred to collectively as “Cumulus”).

In consideration of Participant being allowed to participate in the Event, including parking space for your car and selling space, and for other good and valuable consideration, the receipt and sufficiency of which I hereby acknowledge, I hereby promise and agree as follows:

  1. I am over the age of 18 and I have the legal authority to execute this agreement.
  2. I, by signing this Agreement, acknowledge that there are certain risks associated with my participation in the Event, any of which could result in serious bodily injury or death to me. I represent, warrant, covenant and agree that I am participating in the Event entirely of my own choice and volition, and that it has not been requested, suggested or required in any way by Cumulus that I participate in the Event.  I acknowledge and recognize that my participation in the Event could involve potential danger to my person and property, and I knowingly and voluntarily intend to participate in the Event after being apprised of such danger. 
  3. I, on my own behalf and on behalf of my heirs and assigns, do hereby now and forever fully and finally release, remise, acquit and discharge Cumulus of and from any and all rights, claims, debts, damages, demands, actions, liabilities, responsibilities, causes of action, covenants, suits and judgments, of any kind or nature whatsoever, whether known or unknown, developed or undeveloped, anticipated or unanticipated, discoverable or undiscoverable, which I have, might have, or might claim to have against Cumulus, arising out of or in any way related to or associated in any way with regard to my participation in the Event, and any injury, damage or loss of any nature related to or arising out of or in connection therewith.
  4. I, on my own behalf and on behalf of my heirs and assigns, do hereby covenant and agree not to sue Cumulus upon any claim, demand, right of action, cause of action, lawsuit, damage, loss or expense of any nature whatsoever, in law or in equity, which I now have, have had, or may hereafter claim to have or have had, against Cumulus arising from or by reason of any matters, conduct, transactions, liabilities or obligations with respect to the Event as to which any Cumulus entity might have any resultant liability to me.
  5. I hereby represent, warrant, covenant and agree as follows:

I understand and agree that this Agreement is not, and shall not be construed as, an admission by any Cumulus party of any liability whatsoever. This Agreement and each of its provisions shall not be offered or received in evidence in any action or proceeding as an admission or concession of liability of any nature on the part of any Cumulus party.  I further understand and agree that this Agreement contains the entire agreement between Cumulus and me relative to its subject matter, and no representations or agreements, oral or otherwise, between the parties not included herein shall be of any force or effect.

I hereby grant Cumulus the right to use my name, likeness, voice, biographical and other information for advertising, promotional, and related purposes in connection with the activities or promotion of the Event.

The parties agree that the terms of this Agreement shall be binding upon and inure to the benefit of the parties and their respective heirs, successors and assigns. Notwithstanding anything herein to the contrary, this Agreement shall be fully enforceable by either party in any action at law or in equity, and nothing contained herein shall preclude or be construed to preclude any action in law or in equity by either party against the other to enforce the provisions of this Agreement.  This Agreement shall be governed by and enforced and interpreted in accordance with the law of the State in which the Event takes place.  If any provision of this Agreement shall be determined to be void or unenforceable by a court of competent jurisdiction, the remainder of this Agreement shall remain valid and enforceable by any party.
